“In response to the prosecution and charges brought against me, I would like to provide the following in my defence:
I would like to talk about why I practise Falun Gong, the truth about Falun Gong and why I am not guilty.
I borrowed Zhuan Falun [the main text of Falun Gong] from a colleague of mine in the summer of 1996. After reading the book, I immediately came to realise a lot of answers to questions I’d always had. At the same time, I became healthier and felt my mood turn to one of light-hearted happiness. I heard many amazing stories about the benefits that other people received from practising Dafa. As time went by, I became a better and better person as I improved in my Falun Dafa cultivation. I realised why emperors and princes have left their kingdoms to go and practise cultivation. I realised why ordinary people experience birth, old age, sickness and death. I also learned more each time after I finished reading. The more I read Zhuan Falun, the more I found endless and boundless meanings in the book.
In July 1999, when the unfounded persecution of Falun Gong suddenly began, leaders of each work unit began to try and force all Falun Gong practitioners to withdraw from so-called “illegal organisations” and to write a “guarantee letter” [to give up Falun Dafa]. If they did not do this, they would lose their jobs. I practise Falun Gong voluntarily and have never joined any organisations. My health has benefited from Falun Gong and I have received many valuable things that cannot be bought with money. Why would I write a so-called “guarantee letter” to give up practising Dafa? Besides, citizens have the right to free speech and I do not have any obligation to write the “guarantee letter”. So, I refused to write it and my work unit fired me.
I went to the Credit and Investigation Bureau in Jinchang to tell them the truth on January 5 2000. A policeman sent me to a detention centre. After 15 days, my work unit supervisor in my new job continually tried to force me to write a “guarantee letter”. I refused to do so, and became jobless again. I thought that justice must exist somewhere, even though I was in places where injustice and illegal deeds are supported. Therefore, I went to visit Beijing. However, I was caught and put in detention before my arrival in Beijing and was accused of false charges. There were several dozen other people who were arrested because they went to Beijing. After I was released, the security section in my work unit deceived me into attending a so-called “re-education class” in Longshou, which was in fact a forced brainwashing class. In this brainwashing class, a portion of our wages was illegally confiscated, we didn’t have any personal freedom, we ate and lived in the class and the police watched us constantly. Without writing a guarantee to give up practising or a “letter of repentance“, we were not to be released. I was illegally detained for almost half a year. I asked the person in charge of the brainwashing class, “What type of class are we in – a detention centre or a learning class?” My question was not answered, so I asked the city court the same thing. They then released me. There were some male practitioners who had to stage a large hunger strike to secure their release.
Back at my work unit, I was forced to leave my position because I refused to write a “guarantee letter”. I was told that I had to write a guarantee not to practise Falun Gong so that I could get the wages owed to me. I asked the leader of my unit, “Are my wages based on my hard work or are they payment for writing?” He could say nothing, but I was still deprived of my legal rights to take leave or to go out from my work unit. My work unit was just like a jail. I told them, “You have no right to deduct my wages at will, and no right to deprive others of their legal rights and interests. What you are doing is an abuse of your position of authority, which is illegal.” It was just because I wouldn’t give in to their persecution that my work unit fired me. Before they fired me, they would never allow me to say a true word. Therefore, I applied for early retirement. However, they not only declined but also found an excuse to fire me, and they deducted a large amount of the subsidies [similar to a pension] that I deserved for my accumulated working years.
On January 17 2001, I was kidnapped without reason by the branch office of LongShou and taken to the Public Security Office. They illegally searched my house and found some handwritten copies of Teacher Li’s articles. They completely distorted the facts and insisted on saying that they were a large amount of “reactionary flyers”, using this as an excuse to send me to an administrative detention centre for 15 days. They also imposed another additional crime on me and I was illegally transferred into criminal detention for another six months. Because I wrote an appeal letter to a local Investigation unit, I was released again and found not guilty. As they didn’t meet their final purpose through one persecution after another, I was persecuted even more cruelly the next time. They wildly vented their personal anger on me. On April 9 2002, about seven or eight people from LongShou Branch knocked out my window and kidnapped me to the branch office. I was cruelly tortured and kept awake for several days. After seven or eight days, they again imposed an additional crime on me and I was taken to another jail with my mind still unclear after the cruel torture.
Since I was illegally imprisoned and detained, I expressed my true opinion to the Investigation unit. However, they all heard but paid no attention to it. They instead prosecuted me, the one who has been persecuted, and let those who break the law and commit crimes remain above the law itself. Isn’t this to cover up the fact that those who are supposed to uphold the law are actually the real criminals? Isn’t everyone supposed to be equal according to the law? According to Constitution 41, it is required to make a thorough investigation of each charge, each report on the guilt of others, and any litigation by citizens; suppression is not allowed - nor is attack or revenge. According to Criminal Law 188, judges are to be investigated if they perform any of the following: practise favouritism and corrupt conduct, charge people who they know are innocent and cover up the evidence by colluding together when they know someone is guilty.
In China, there’s no place that upholds justice and there’s no place to appeal against injustice. For the past three years, I’ve suffered from persecution that I should never have suffered from. Other practitioners have been illegally detained, sent to labour camps, sentenced to jail and been cruelly tortured.
Why do Dafa practitioners go to Beijing? Going to Beijing is a right, a responsibility and an obligation granted by the Constitution to Chinese citizens who are treated unjustly. However, those who go to Beijing are imprisoned. Why do Dafa practitioners distribute flyers? It’s because there’s no place where justice is upheld and there’s no place to report injustice. This form is used to reveal the truth about the persecution – is it against the law? Why do practitioners post flyers on walls? When facing the authorities and when facing those that administer the law, the law fails to stand for justice – is it illegal for practitioners to post flyers on walls saying, “Don’t Illegally Arrest Dafa practitioners. Immediately Release all those who have been Detained.” Does this warrant imprisonment and torture? May I ask who is really breaking the law? Practitioners who share experiences with one another are labelled as taking part in an “illegal gathering” or a “reactionary gathering”. In short, there are no laws being applied for Dafa practitioners. Each word, action and movement is considered to be “against the law”. As a result, they arrest practitioners at will, lock them up and sentence them, whereas the purpose of practitioners’ actions and deeds is to let people who do not yet know Falun Gong to come to know the truth.
Why tell the general public the truth about the persecution? Dafa practitioners cultivate Truthfulness, Compassion, Tolerance. Aren’t they cultivating “Truthfulness” when they are telling people the truth about Falun Gong and the persecution? Aren’t they cultivating “Compassion” when they tell people good things? Whoever says that Falun Gong is good is fired from their job, sentenced to imprisonment and cruelly tortured. However, Falun Gong practitioners still stand up and tell people that Falun Gong is good – aren’t they cultivating “Tolerance”? Aren’t they noble? Now, we have a situation where the truth is regarded as fake. We also have a situation where those who commit crimes are out of the law’s reach. Our current actions are to tell the truth to people. We do not have wish to overthrow the government, nor do we wish to commit any other crimes.
Let’s take a look at some historical facts; didn’t all miscarriages of justice eventually receive a redress? Governments make mistakes in decisions. It is also possible that some laws haven’t been correctly formed and are constantly modified, abolished or changed. As far as identifying the laws that Falun Gong practitioners have broken – we haven’t broken any laws. Laws should be discussed, voted on and put into practise. But Falun Gong was suddenly made an illegal organisation overnight. Is this normal?
To summarise, I am not guilty. Dafa practitioners are not guilty.
Those who abuse their authority and consider themselves above the law, by administering yet abusing the law are the guilty ones. How can practitioners be guilty for revealing the truth to the public? What kind of guilt is that? Maybe the law does not currently punish your evil deeds because of your power and influence. However, there is justice in this world. Those who have done wrong deeds will surely suffer the consequences.”
